Acceptance of Terms
By accessing or using Level Rebel (the "Service"), you agree to these Terms of Service ("Terms"). If you don't agree, stop using the Service.
These Terms form a binding agreement between you and Level Rebel Media, Inc. ("Level Rebel," "we," "us," or "our"), a DBA of Brian Arbuckle Music, Inc. We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the revised Terms.
Description of Service
Level Rebel is an audio analysis and scoring tool. You upload an audio file; the Service processes it against platform-specific loudness targets and headroom specifications, returns a numeric score, and provides a conformed export file ready for upload.
Core workflow:
- Audio file upload and processing
- Platform assessment against loudness and headroom specs
- Scored output (0–100) with diagnostic detail
- Conformed export file
User Accounts
Eligibility
You must be at least 18 years old and capable of entering a binding contract to use the Service. If you're using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Accuracy of Information
You agree to provide accurate, current, and complete information when creating your account, and to keep that information up to date.
Account Security
You're responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@levelrebel.net if you suspect unauthorized access.
Acceptable Use
Audio File Ownership and Rights
You must have the right to upload and process any audio files you submit to the Service. By uploading a file, you represent that you own it or have the necessary rights, licenses, and permissions to process it.
Prohibited Uses
You agree not to:
- Upload audio you don't have rights to process
- Use the Service to infringe third-party intellectual property rights
- Attempt to reverse-engineer, copy, or replicate the assessment algorithms
- Use automated tools to scrape, crawl, or bulk-process files beyond your subscription tier
- Introduce malicious code or attempt to breach the Service's security
Subscriptions and Billing
The Service offers subscription plans billed through Stripe. By subscribing, you authorize Level Rebel to charge your payment method on a recurring basis until you cancel.
- Auto-renewal: Subscriptions renew automatically at the end of each billing period. You'll be charged the then-current rate unless you cancel before the renewal date.
- Cancellation: You can cancel at any time from your subscription management page. After signing in, select Manage billing to manage or cancel your subscription through Stripe. Cancellation takes effect at the end of the current billing period; you retain access until then.
- Refunds: Subscription fees are non-refundable, except where required by law or at our sole discretion. If you believe you were charged in error, contact us at hello@levelrebel.net within 30 days of the charge.
- Price changes: We'll give you at least 30 days' notice before increasing subscription prices. Continued use after a price change constitutes acceptance.
Beta Software
The Service is currently in beta. During this period:
- The Service may be unavailable, interrupted, or changed without notice.
- Features may be added, modified, or removed at any time.
- Assessment results may change as we refine the scoring algorithms.
- You use beta features at your own risk; the warranty and liability disclaimers below apply with particular force during the beta period.
We'll do our best to keep the Service running, but we make no uptime guarantees during beta.
Intellectual Property
Level Rebel's Rights
The Service — including the assessment algorithms, scoring engine, codebase, design, and all associated intellectual property — is owned by Level Rebel Media, Inc. These Terms don't transfer any ownership rights to you.
Your Rights
You retain full ownership of any audio files you upload and any output files the Service generates from your audio. We don't claim rights to your content. Your uploaded audio is processed entirely in your browser via WebAssembly and is never transmitted to our servers. We do not use your audio, your saved score, or any derived diagnostic data to train machine-learning models, including the assessment algorithms themselves.
If you believe content posted on Level Rebel infringes your copyright, email hello@levelrebel.net with a description of the work, the URL of the material in question, and your contact information. We review every such notice and remove material as appropriate.
Privacy
How we collect and use your data is described in our Privacy Policy. By using the Service, you consent to those practices.
Resolving Disputes
If something goes wrong, the fastest path is to email us at hello@levelrebel.net with the subject line "Dispute" and a description of the problem. We'll respond within 10 business days and try to resolve it directly. Most problems get solved this way.
If informal resolution doesn't work, you keep your right to file in small-claims court for claims within that court's limits. For other disputes, the Governing Law section below applies and the courts in Delaware have jurisdiction.
Each side bears its own legal costs, except where a statute or court order says otherwise. Nothing in this section limits your rights under any consumer-protection statute that applies in your jurisdiction.
Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms, or for any other reason at our discretion. You can delete your account at any time from your account settings.
On termination, your right to use the Service ends immediately. Sections that by their nature should survive termination — including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Governing Law — will survive.
If we terminate your account for a Terms violation, your saved scores and account email are deleted within 30 days, except where we are required to retain billing records for tax or accounting purposes.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, LEVEL REBEL DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We don't warrant that the Service will be uninterrupted or error-free, or that assessment results will be accurate for every use case. Audio platform specifications change; we'll work to keep assessments current, but we make no guarantees.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LEVEL REBEL'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
IN NO EVENT WILL LEVEL REBEL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or the Service will be resolved in the state or federal courts located in Delaware.
